Do we assume that it was actually him and change the "legally declared dead" to something like "possibly not dead" or "possibly dead", or do we assume that he is still dead and this was someone that acquired his login and password? (possibly through his will/estate/probate)

Something as precious as a WTF login as SDB is worth a lot. It would have had to been willed to someone.

I say we monitor him closely for the next few days before making any decisions.
