Detroit News - Pistons reserve center Dale Davis was arrested early Tuesday morning in Miami Beach, Fla., after an altercation with police that ended with a Taser shot, the Detroit News is reporting.

Davis has been charged with four misdemeanors: disorderly conduct, resisting arrest without violence, assault and assault of a law enforcement officer.

Each count carries a maximum of six months in jail and a $500 fine.

According to the police report, Davis threatened officers and had to be subdued by a Taser to be arrested. The Taser burst left small puncture marks on his chest and abdomen, according to police.

Davis' agent, Chubby Wells, said they are looking into their legal options against the Miami Beach police department.

"We're talking to attorneys right now," Wells said Wednesday.

"It's Dale's name on the line, and all I can say is that things did not go down the way they say it did."

Davis had every right to be frustrated in Miami. Dumars left him there after the playoffs to search for the Pistons missing offense, and it's been months with no progress. It was just a matter of time before he blew a fuse . . .

btw, dale was probably slotted in for ~20 minutes per game in our rotation. we're uber fucked if this is the end for him as a piston, though pennypincher probably creamed his pants over the idea of not owing dale the 3.5 million he owes him for next year.

Detroit Piston Arrested In Miami

Davis Charged With Assault, Disorderly Conduct

A member of the Detroit Pistons was arrested after an alleged disturbance at a Florida hotel.

Forward Elliot Lydel Davis (pictured) -- who is commonly known as "Dale Davis" -- was at the Courtyard Marriott hotel in Miami Beach when the incident occurred at about 2 a.m. on Tuesday, according to WTVJ Television. Hotel security guards allege that Davis shouted obscenities at them, the station learned.

Davis was charged with assault, disorderly conduct and resisting arrest.

He has since posted at $5,000 bond.

NBA Player Arrested On South Beach

(CBS4 News) MIAMI BEACH A Detroit Pistons basketball player has found himself on the wrong side of the law while on a visit to South Florida.

Eliott Lydel Davis, 37, who is known in the NBA as Dale Davis, was arrested by Miami Beach police early Tuesday. He bonded out the same day.

Miami Beach police spokesman Bobby Hernandez says Davis refused an officer’s command to take his hands out of his pockets, and then challenged the officer to a fight.

Security guards at the South Beach Marriott, 161 Ocean Drive, called police to report that a belligerent Davis was threatening them around 2 a.m. Tuesday, Hernandez said.

When police arrived and he refused to cooperate, an officer shot him with a stun gun and placed him under arrest.

Davis was charged with two counts of assault, disorderly conduct and resisting arrest without violence.

He was released after posting a $5,000 bond.

The Pistons also are aware of the arrest.

"We are not going to comment publicly on this until we get all the information," Pistons representative Kevin Grigg said.

According to the police report, Davis allegedly caused a disturbance and assaulted someone at the South Beach Marriott.

Hotel security called police, and the officers confronted Davis in the lobby.

The police report did not say Davis was intoxicated or otherwise impaired.

Davis allegedly refused police orders to produce identification. A friend who was with Davis calmed him and got him to produce the ID.

Miami Beach police representative Bobby Hernandez said the incident could have ended there, without the arrest, if Davis had been cooperative.

"Once you threaten police, it's over," Hernandez said Wednesday night. "You can't go there."

The police and Davis proceeded outside, where Davis allegedly began to shout a profanity and accuse the police of targeting him because of his race. Things escalated when Davis allegedly put his hands in his pockets, a move police saw as a threat. They demanded he show his hands.

Davis responded: "I don't have a gun! Are you going to shoot me?"

He eventually removed his hands but then balled up his fists, as if ready for a fight, and walked threateningly toward officers, according to the report.

Davis was ordered to stop, or the police would use the Taser -- a device that shoots two probes, up to 30 feet, to deliver an electrical charge. The quick burst of electricity temporarily immobilizes the victim.

Davis ignored repeated orders to stop moving toward officers with his fists clinched, the report said. The police shot Davis with the Taser. He fell and was subdued for the arrest. Police said he was cooperative in custody.

Davis now will be subpoenaed for arraignment.

Hernandez said it is common for these types of cases to end in a pretrial diversion agreement, allowing a person to perform anger management or community service.

If Davis takes a diversion agreement, the charges will not appear on his record.

Davis isn't the only athlete recently arrested in Miami Beach.

Guard Gilbert Arenas and forward Awvee Storey of the Washington Wizards and former Ohio State receiver Santonio Holmes, now a rookie with the Pittsburgh Steelers, were arrested in May after run-ins with the police.

The big disappointment is that I've yet to see an account of this incident which even attempts to explain why police were called in the first place. Maybe no one knows, or maybe all the reporters think the arrest is the story, not the preceding events.
It looks like the Free Press tried to look deeper into the events but were stonewalled:

A spokesman at the Miami Beach Police station couldn't locate the written police report Wednesday night, and managers at the Courtyard Miami Beach South Beach and the Courtyard Miami Beach Oceanfront said that the occurrence did not happen at their hotels.

Pistons forward Dale Davis and his agent Chubby Wells sought legal counsel Thursday to explore filing a lawsuit against Miami Beach police for their actions in Davis' arrest early Tuesday morning.

Wells said Davis' version of the incident -- which resulted in four charges and the use of a Taser gun -- differed from the police report.

"We do plan to file a suit against them," Wells said. "We're in the process talking with lawyers about filing something because, honestly, this was ridiculous."

Joe Dumars, Pistons team president of basketball operations, said he planned to speak with Davis on Thursday evening, and until then would decline commenting on the four charges that Davis, 37, received after a confrontation with hotel workers and police.

According to the police report, hotel security workers at the South Beach Marriott called police about 2 a.m. Tuesday after they said Davis shouted profanities and threatened to fight them in the hotel lobby. The two workers told police they feared for their safety and that Davis refused to leave.

Police approached Davis, told him to gather his belongings and leave the hotel. According to the report, Davis became irate and said, "I'm not going anywhere." When asked for ID, he asked "What the (expletive) for?" Then he said, "You can have my ID, but I ain't leaving."

A friend told Davis to calm down and give the officers his ID. Davis and the officers went outside where Davis paced in a circle, shouted profanities and stated that the officers had targeted him because of his race.

Police say they asked him to stop. Davis continued and put his hands in his pockets. Police asked him to remove his hands for "officer safety." Davis said, "I don't have a gun! Are you going to shoot me?"

Police say they asked again, and Davis pulled his hands from his pockets, holding three cell phones, money and credit cards. He put them back into his pants and said if the officers removed their badges and guns, he'd beat them up. Police asked him to calm down, but Davis continued shouting.

Then, grinding his teeth, Davis removed a chain from his neck, balled his fists and walked toward the officers in an "aggressive manner," the report read. The police advised Davis they would use a Taser if he continued.

He kept advancing, so the officers used the Taser on him. Davis fell to the ground with two puncture wounds in his chest and abdomen.

Once subdued, officers arrested him, charging him with resisting arrest without violence, disorderly conduct, assault and assault against a police officer.

Wells said the police were aggressive, confrontational and quick to use their Taser against Davis. He also said they verbally threatened him and baited him.

No arraignment date had been set, and Wells said he received support from numerous NBA teams who called to complain about the Miami-area police. Earlier this year, Washington Wizards star Gilbert Arenas was also arrested in Miami after an altercation with police.

somehow, our only back up center being arrested while tweeking out on drugs seems to be an improvement on this offseason, as far as im concerned. atleast i can laugh about this one.

Pistons forward Dale Davis said his lawyer likely will enter four not-guilty pleas on his behalf at an arraignment this morning in Miami Beach, Fla.

Davis was charged with resisting arrest without violence, disorderly conduct, assault and assault against a police officer in the early hours of Aug. 1 after an incident at the South Beach Marriott.

According to the police report, hotel security workers called police around 2 a.m. after they said Davis shouted profanities and threatened to fight them in the hotel lobby. The two workers told police that they feared for their safety and that Davis refused to leave.

Davis appeared Thursday at a Detroit charity event he organized through the Pistons. Children received back-to-school supplies, free haircuts and autographs from Davis, forward Jason Maxiell and Shock center Kara Braxton.

Davis said he could not comment on the particulars of the incident, in which police used a Taser to subdue him. Police say he advanced toward them with balled-up fists.

"I know I didn't commit any crimes," Davis said. "That's the main concern right now."

Davis said he and his agent, Chubby Wells, were considering a lawsuit against the police, but they would decide after today's arraignment, in which the judge will set a date for trial or delay the proceedings.

"At this point," Davis said, "I'm just waiting to see what happens."

MIAMI (AP) -- Detroit Pistons center Dale Davis was acquitted Friday on assault charges stemming from an altercation with police.

After deliberating for nearly two hours, the jury found Davis -- shocked with a stun gun by police -- not guilty of three counts of assault, one count of assault on a law officer and one count of resisting an officer without violence.

"It's been a long two days. I'm glad it's over. It was very difficult. Justice was served," said the 6-foot, 11-inch basketball player said.

He said he had not yet decided whether to file a civil lawsuit against Miami Beach police. A telephone call placed to a Miami Beach Police spokesman was not immediately returned Friday.

Davis was arrested Aug. 1 at a Miami Beach hotel and was accused of threatening security guards and police and leveling profanities at them, a police report said.

Police were called to the hotel by the security workers and officers repeatedly asked Davis to leave, but he refused, the report said.

After giving officers his identification, Davis and the officers went outside, where he accused the officers of targeting him because he is black, the report said.

Police said they asked Davis to remove his hands from his pockets for officer safety, and Davis complied after asking officers if they were going to shoot him.

Davis pulled out money, three cellular phones and credit cards, the report said. He put the items back in his pockets and said he'd beat up the officers if they took off their badges and got rid of their guns, the report said.

The report said Davis then balled his fists and began walking toward officers in an aggressive manner, and he was warned that he would be hit with a Taser if he continued, police said. He didn't stop, so an officer zapped Davis in the chest and he fell to the ground. He was taken into custody and charged.
