I think it depends on the type of gambling your talking about. I'm pretty sure home games are legal. Obviously gambling in a casino is legal. I think the only thing thats illegal is if its sorta like those underground casino sorta deals. Like in the back of that Resturant in Rush Hour 2.

Gambling online is technically illegal and they're trying to push legislation in congress to make it vry difficult to play.

Home games are definitely illegal as well, but rarely prosecuted.

but I guess gambling "fake money" is still ok.

I don't see whats so bad about gambling, especially if you work and earn your money.
