Almost any of the Dems can win this if a) they can raise the money b) they can avoid any splintering or major inner-party sub-factions from forming c) a major third party candidate doesn’t enter and fuck it up. Avenatti, of course, wanted to be the tough guy candidate that he’s describing, but his recent criminal/legal trouble squashed that hope, so this article just reeks of sour grapes to me. How fucked up would it be to see Trump “sponsor” a 3rd party candidate to siphon off votes from the Dems so his 36% would have a chance at being enough? Yes, crossing the border largely as described in the statute should be a crime. There could be better language for political refugees, but mostly it seems fine to me. The law's been in the books for a hundred years or so. Arguably, the criminal penalties that Section 1325 could impose are stupid. It's like a misdemeanor and up to 12 months of jail for jaywalking. Part of the point of such excesses in potential sentence is to discourage bad behavior. Part of the point is to give prosecutors more shit to throw at people who did something bad they can't really be pinned on. It's the "we got Al Capone for tax evasion" approach, where his sentence was disproportionate to the actual tax crime and typical sentence for such acts in that era, because he was a killer mob boss. Personally, I think that shit is stupid. What Trump's perpetuated is prosecuting everyone for that to the full extent, even asylum seekers. That's stupid. But, the real problem is Trump, moreso than the law. Most presidents before didn't use this law to justify fucting concentration camps. Getting rid of it is a way to stick it to Trump, but the real fix here is to get his ass out of office. With a sane preisdent, if you didn't have a Section 1325, you'd want to have a law that's pretty similar. It's unclear to me if such similar laws already exist.
