SCOTUS indicated that Bush military tribunals violated the Geneva and the UCMJ, that Gitmo detainees have the right of habeas corpus. Obama wasn't the one who gave them Constitutional rights. AFAICT, the only reason that a civil court might do something less than put these fuckers in supermax prisons for life is because of the fucked-up justice they've had prior to this point. Instead of keeping them interminably, waterboarding in the shadows, imagine we'd kept them front and center and gone to trial in a couple years as we did with McVeigh. There wouldn't be big questions about the handling of the prisoners afterwards. When prosecutors cite state secrets as why parts of their case are classified, the defense wouldn't have much recourse or sympathy.

That's more-or-less what happened with the Oklahoma City bombings in the 1990s. The investigation was massive, there was a dramatic change of venue, and McVeigh received a death sentence in 2 years.
